CD/DVD Writer's Registration With Optical Media Board

An i-café that offers CD-Burning service to its customers is required to register the optical media writer (CD/DVD writer) being used for the purpose with the Optical Media Board (OMB). According to the Optical Media Act of 2003, CD-burning service falls under the definition of replication and hence the owner of an establishment offering the service must register the equipment with OMB.

Regarding this regulation, a question often asked is "After an i-café registered its CD/DVD writer with OMB, can it now, for a fee, legally copy songs, movies, etc. that customers request them to do?". The answer to this question is NO, the registration of the CD/DVD writer with OMB is NOT a license for the i-café to go on and produce copies of copyrighted materials. The permissions of the copyright owners are still needed before anyone can legally reproduce their intellectual properties.

An i- café with registered CD/DVD writer can only legally burn the research work or thesis of students, videos of weddings, birthdays and other gatherings taken by certain individuals who are the same persons who request for the copying of the said materials. With these limitations, the next question being asked by i-café owners is "Will CD-Burning service still be financially rewarding for i-cafés if the OMB Law gets fully implemented?"

It must also be mentioned that to fully comply with the provisions of the Optical Media Law, the i-café with a registered CD/DVD writer must keep a 5-year record of inventory of materials (blank CDs and DVDs) and the kind of copying jobs done including the names of customers. who availed of its CD-Burning service. Registration with OMB is done annually with a fee of PhP500.00 per CD/DVD writer and such records may be required during renewals.

  1. actually in my opinion di na po uso cd/dvd burning ngayon. dahil po sa usb drive at memory cards. nagpapadownload nang mp3/mp4/3gp files instead na ipa burn sa cd /dvd nilalagay na sa usb or upload sa memory card nang smartphone/ iphone/ at ipod tapos meron na din vcd/dvd players na pwede u.s.b gamitin instead of disc.
    kadalasan sa mga istudyante may dala sariling u.s.b drive pang kopya nang reaserch nila.

  2. I seriously doubt if the schools would require their students to submit copies of the research work and/thesis in USB flash disks. Aside from the cost involve in using USB flask disk in the submission of their school work, data permanence could also be an issue if they do so. I believe students would still have to submit them in CDs or DVDs in the days to come.

  5. OMB sucks!!! PAPT sucks!!! twice reported with no glorifying actions. they only do their works in front of media. Remind you guys BSA giving rewards is a HOAX, based on my experienced.
